Please read these Terms of Service ("Terms") carefully before using the TripsTranslator website, bot, and related services (collectively, the "Service"). TripsTranslator ("we", "us", or "our") provides live AI chat-translation and related tools for Twitch streamers.

By accessing or using the Service, you agree to be bound by these Terms. We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to and use of the Service at any time.

1. Our Services

TripsTranslator is a Twitch bot that provides:

• Real-time Twitch chat translation powered by AI, across 100+ languages.
• Per-channel configuration, including setting a target language (!trlang) and removing the bot from a channel (!trleave).
• Self-serve onboarding through Twitch authorization.

Features may be added, changed, or removed at any time as the Service evolves.

2. Beta Status

The Service is currently offered as a free public beta. During the beta, no payment is required. These Terms — including all disclaimers, liability limits, and refund provisions — apply in full now and will continue to apply if and when paid subscriptions are introduced. We make no guarantee that any feature, price, or free-access period will continue.

3. Eligibility

• You must be at least 13 years old to use the Service.
• If you are under 18, you must have permission from a parent or legal guardian.
• You must comply with Twitch's Terms of Service and Community Guidelines at all times. Your use of Twitch is governed by Twitch, not by us.

4. Accounts & Authorization

• Authorizing your Twitch account is required to use the Service.
• You are responsible for activity that occurs through your authorized channel.
• You may remove the bot at any time using !trleave or by revoking access from your Twitch connections settings.
• Beta testers, invited channels, and supporters may receive extended or comped free access at our discretion.

5. Payments, Subscriptions & Refunds

If and when paid subscriptions are offered, the following terms apply:

• Subscriptions may be processed through third-party payment processors (such as PayPal or Stripe). Payment extends your account validity by the purchased duration.
• All sales are final. Refunds are not provided once a subscription period has begun.
• In the event of any refund, chargeback, or payment dispute, the maximum reimbursement you may be entitled to is limited to the equivalent of one (1) 30-day subscription payment — regardless of the length of your subscription, the number of purchases made, or the number of billing periods involved.
• Initiating a chargeback or dispute without first contacting us may result in immediate and permanent termination of the Service to your channel.
• We are not responsible for fees, currency conversion, or charges imposed by your payment provider or bank.

6. Acceptable Use & Fair Usage

You agree not to:

• Abuse, spam, overload, or exploit the bot or its infrastructure.
• Interfere with, reverse engineer, resell, or tamper with the Service.
• Use the Service for unlawful, harassing, hateful, deceptive, or fraudulent activity.
• Attempt automated, bulk, or off-platform translation outside of live Twitch chat.

Fair Usage. TripsTranslator is intended for normal-sized Twitch communities. Channels generating extreme chat volume (for example, very large streams producing many hundreds of messages per minute) are not supported under standard access and may require a separate arrangement. To protect stability and availability for all users, we reserve the right to throttle, rate-limit, or automatically leave any channel that exceeds fair usage or degrades service for others.

7. AI Content & Disclaimers

• The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• You understand and accept that translations may be inaccurate, mistranslated, hallucinated, offensive, or otherwise unexpected, and that AI output is generated automatically and does not reflect the views of TripsTranslator or its operator.
• You are solely responsible for how translated or AI-generated content appears in your channel and how your community reacts to it.
• We are not responsible for translation errors, missed messages, downtime, interruptions, data loss, or the actions of third parties.
• The Service depends on third parties (including Twitch, payment processors, network providers, and AI infrastructure). Outages or changes on their side may affect availability, and we are not liable for them.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall TripsTranslator or its operator, affiliates, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or reputation, arising out of or related to your use of (or inability to use) the Service — even if advised of the possibility of such damages.

Our total aggregate liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount you actually paid us for the Service in the one (1) 30-day period immediately preceding the event giving rise to the claim. Where no payment was made (including during the free beta), our total liability shall be zero.

9. Indemnification

You agree to indemnify and hold harmless TripsTranslator and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

10. Termination

We may suspend or terminate access to the Service at any time, with or without notice, if you violate these Terms, exceed fair usage, or for any reason at our sole discretion. You may stop using the Service at any time by removing the bot from your channel.

11. Changes to These Terms

We may update these Terms at any time. Changes are effective when posted and reflected by a revised "Last updated" date. Continued use of the Service after an update constitutes acceptance of the revised Terms.

Your use of the Service is also governed by our Privacy Policy. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
